Accessibility Declaration for the OANDA TMS Brokers S.A. ecosystem 

The information concerns the accessibility requirements specified in the Act of April 26, 2024 on ensuring accessibility requirements for certain products and services by economic entities (the "Act"). 

The declaration refers to brokerage services provided based on the authorization of April 26, 2004 , No. KPWiG-4021-54-1/2004, and payment services provided based on the authorization of January 19, 2016, No. DLB/WIP/700/15/3/2016/JS by OANDA TMS Brokers S.A. with its registered office in Warsaw at Rondo Daszyńskiego 1, 00-843 Warsaw ("OANDA TMS").

Compliance Status 

As of the date of this Declaration, the OANDA TMS service ecosystem is non-compliant or partially compliant with the Act . The service ecosystem consists of:

Communication Channels

At this moment, we do not provide service in Polish Sign Language (PJM). 

Website Accessibility 

Our websites are partially compliant with the requirements of the Act. We ensure: 

  • Appropriate contrast – most text and graphic elements meet contrast requirements (minimum 4.5:1), which facilitates the use of the services for visually impaired persons.
  • Compatibility with screen readers.
  • Correct header structure and logical content layout.
  • Use of simple and understandable language.
  • Keyboard navigation with a screen reader. 

Unmet requirements: 

  • We use external platforms on the site, such as YouTube, and plugins from independent providers.
  • All kinds of multimedia players from external service providers, embedded content, and associated chat are sometimes described in different languages (usually English).
  • Alternative texts for some visual and interactive elements are not added or not implemented.
  • Some links and interactive elements may be too small for people with visual impairments.
  • Some visual elements require increased contrast. 

Applications and Platforms: 

OANDA TMS Brokers Mobile Application 

  • The OANDA TMS Brokers mobile application, available for iOS and Android operating systems, is not compliant with WCAG 2.1 AA requirements.
  • We are currently working on implementing accessibility on the mobile platform. 

TMS Kantor Transaction Platform 

The TMS Kantor transaction platform is partially compliant with accessibility requirements. The platform ensures : 

  • Appropriate contrast – most text and graphic elements meet contrast requirements (minimum 4.5:1), which facilitates the use of the services for visually impaired persons ;
  • Compatibility with screen readers.
  • Correct header structure and logical content layout.
  • Use of simple and understandable language.
  • Keyboard navigation with a screen reader. 

External Access Channels 

  • External access channels, such as the MetaTrader 5 transaction platform, the MetaTrader mobile application, or TradingView, may not meet accessibility requirements.
  • These channels are managed by external providers. OANDA TMS has no influence on the functionality of these tools. 

Documents and Language Accessibility 

  • We make every effort to ensure our documents are drafted in simple and understandable language.
  • In agreements and regulations, we use specialized terminology and concepts used in the area of investment services. 

Architectural Accessibility 

The Unit building located at Rondo Daszyńskiego 1, 00-843 Warsaw was designed in accordance with the recommendations of the "accessibility+" program and obtained the "Facility without barriers" certificate. 

Accessibility details are presented below: 

  • The building provides paid parking.
  • You can come with an assistance dog or a guide dog. Remember the assistance dog certificate and vaccination certificate.
  • We provide water for the pet.
  • Buttons in the elevator are described in Braille.
  • Doors are marked with contrast in a way noticeable to visually impaired persons.
  • The height of the reception counter is appropriate for people moving in a wheelchair.
  • Bathrooms are equipped with handrails or handles enabling a disabled person to use the toilet.
  • Access to basic spaces of the building is facilitated for people with physical disabilities; there are no thresholds, and floors are covered with an anti-slip finish.
  • Light switches are visibly marked and located at a height allowing access for people in wheelchairs.
  • Building entrances, passageways, and entries are adapted for wheelchairs.
  • Steps are marked with bright paint to make them easier to distinguish for visually impaired persons.
  • To improve the evacuation of people with mobility difficulties, a special system allowing safe evacuation via elevator has been planned. 

Complaint regarding lack of service or product accessibility 

If you are a consumer, you have the right to file a complaint with us regarding the lack of accessibility of the services provided by us. 

How to file a complaint regarding the lack of service or product accessibility: You can file a complaint regarding the lack of accessibility of our service or product via the following channels:

  • In person — in writing or orally for the protocol at the OANDA TMS headquarters.

What a complaint regarding lack of service or product accessibility should contain: 

  • First and last name;
  • Correspondence address, email address, or telephone number and indication of the preferred method of contact with you;
  • Indication of the product or service concerned by the complaint;
  • Indication of the accessibility requirement that our service or product does not meet, along with a demand for us to ensure its fulfillment. 

What are the deadlines for considering the complaint: 

  • We will consider the complaint regarding the lack of accessibility of our services or products and provide you with a response within 30 days from the date we receive the complaint.
  • In particularly complicated cases where we will not be able to consider the complaint and respond to it within 30 days, we may extend the deadline for considering and providing you with a response to 60 days from the date we receive the complaint.
  • In such a situation, within 30 days of receiving the complaint, we will inform you of the reason for the extension and indicate a new deadline for responding to the complaint. 

How we will provide the response to the complaint: 

We will provide the response to the complaint submitted by you regarding the lack of accessibility of our service or product in the form chosen by you: 

  • To the correspondence address indicated by you in the complaint (by letter), or
  • To the email address indicated by you (electronically), or
  • To the telephone number indicated by you (by phone).
